This Privacy Notice sets out the manner in which RK PURITY APPARELS🛍️ collects, processes, retains and discloses personal information relating to its customers and to visitors to its Website, together with the rights available to such persons and the means by which those rights may be exercised.
1. Identity of the controller
RK PURITY APPARELS🛍️ is operated by RK PURITY APPARELS🛍️, whose registered office is at Compton, CA, 90220.
The Company determines the purposes and means of the processing described herein and is accordingly the controller of that information for the purposes of applicable data protection legislation.
All correspondence concerning this Notice, or concerning the exercise of any right described herein, shall be addressed to support@ramkthrift.space.
2. Scope of this Notice
This Notice applies to www.ramkthrift.space, to all electronic communications despatched by the Company, and to every invoice issued by it. It applies to the Customer whether purchasing as a guest, purchasing through a registered Account, or browsing without purchase.
This Notice does not extend to any third-party website or service to which the Customer may navigate from the Website. Where the Customer is directed to a payment service provider or to a carrier's tracking facility, the privacy notice of that party governs the processing undertaken there, and the Company exercises no control over it.
3. Categories of information collected upon purchase
- Name, together with the name of the intended recipient where this differs.
- Electronic mail address, without which the Company is unable to communicate concerning the Order.
- Delivery address and, where it differs, billing address.
- Telephone number, where voluntarily supplied, disclosed solely to the carrier.
- Particulars of the Order, comprising the Goods purchased, size and colour, sum paid, date, and delivery destination.
- Any further information voluntarily submitted by the Customer in correspondence.
4. Categories of information collected upon registration
- The contact particulars set out above, retained so as to obviate repeated entry.
- A password, retained in the form of a one-way cryptographic hash and incapable of being read by any person, including the personnel of the Company.
- Such delivery addresses as the Customer elects to retain.
- The date upon which the Customer accepted the Company's Terms and Conditions of Sale, together with the version thereof presented.
- The Customer's purchase history.
5. Information collected by automated means
Certain information is collected in consequence of the ordinary operation of a website rather than by voluntary submission:
- Internet Protocol address, required in order that a response may be transmitted.
- Browser and device characteristics, required in order that a page may be rendered appropriately.
- Pages accessed and the time of access, retained within server logs for a limited period.
- Whether an electronic communication despatched by the Company was opened, determined by means of a single transparent image. The Company acknowledges that such evidence is imperfect, certain mail clients retrieving the image automatically and others suppressing it entirely.
6. Payment card information
The Company does not receive, process or retain payment card numbers. Card payments are effected upon a page hosted by the Company's payment service provider, and the card number is not transmitted to the Website or to the server upon which it operates.
The Company receives a transaction reference, the card scheme, and the final four digits of the instrument. Such information is sufficient to reconcile a payment against an Order and to respond to an enquiry concerning it, and is insufficient to effect any charge.
Where payment is tendered by means of a digital wallet, the number disclosed to the Company is a device-specific token generated by that wallet and does not correspond to the number printed upon the Customer's card.
7. Cookies and similar technologies
Two cookies are set without the requirement of consent, such cookies being strictly necessary to the provision of the service requested: one maintains the Customer's authenticated session, and one preserves the contents of the basket. Applicable law does not require consent in respect of cookies which are strictly necessary to a service expressly requested by the user.
All cookies serving analytical or measurement purposes are disabled unless and until the Customer consents. Where the Customer's browser transmits a Do Not Track or Global Privacy Control signal, the Company treats that signal as a refusal of consent and does not subsequently solicit it.
The Customer may delete cookies at any time by means of its browser. Deletion of the strictly necessary cookies identified above will terminate the authenticated session and empty the basket.
8. Electronic communications
Order confirmations, despatch notifications, invoices and receipts constitute communications necessary to the performance of the Contract. Such communications are despatched as occasion requires and are not subject to withdrawal of consent, no consent being relied upon.
The following communications are optional and are despatched only upon consent, which may be withdrawn at any time:
- Notification that Goods previously unavailable have been restocked.
- Reminder that Goods remain within an abandoned basket.
- Invitation to submit a review following delivery.
Withdrawal of consent may be effected by reply to any such communication. The Customer is not required to state a reason, nor to locate a link within the body of the communication.
9. Lawful bases of processing
The Company relies upon the following lawful bases and upon no others:
- Performance of a contract, in respect of all processing necessary to accept, fulfil, charge for and administer an Order, and to deal with any return arising from it.
- Legitimate interests, in respect of the operation and security of the Website, the prevention of fraud, the maintenance of records of despatch, and the analysis in aggregate of trading performance. The Company has conducted a balancing exercise in respect of each such interest.
- Consent, in respect of analytical cookies and the optional communications identified above. Withdrawal of consent operates prospectively and does not affect the lawfulness of processing undertaken prior to withdrawal.
- Compliance with a legal obligation, in respect of records required to be retained for taxation or accounting purposes.
10. Recipients and disclosures
Personal information is disclosed only to those processors engaged in the operation of the Website and the fulfilment of Orders, and in each case only to the extent necessary:
- The payment service provider, for the purpose of effecting payment and responding to any dispute arising from it.
- The hosting provider, upon whose infrastructure the Website operates.
- The electronic mail provider, for the purpose of delivery and delivery reporting.
- The carrier, for the purpose of effecting delivery.
- The analytics provider, and only where consent has been given.
Each such processor is engaged upon written terms restricting it to processing upon the documented instructions of the Company.
The Company does not sell personal information. The Company does not disclose personal information for the purposes of advertising by any third party. Where disclosure is compelled by a court or by a competent regulatory authority, the Company shall comply and shall notify the Customer save where prohibited from doing so.
11. International transfers
The Company and its processors are established within the United States. Personal information is accordingly transferred to, and processed within, the United States irrespective of the Customer's place of residence.
In respect of Customers resident within the United Kingdom or the European Economic Area, such transfer constitutes a restricted transfer. The Company relies upon the standard contractual clauses approved for that purpose, together with the contractual commitments of its processors given thereunder. A copy of the safeguards relied upon shall be furnished upon request.
12. Retention
- Orders and invoices are retained for such period as the applicable revenue authority requires, such records constituting accounting records which the Company is not at liberty to delete upon request.
- Account particulars are retained until the Account is closed, whereupon they are deleted.
- Server logs are retained for a limited period and are thereafter overwritten.
- Records of electronic communications are retained for such period as is necessary to respond to an enquiry concerning delivery.
- Information processed upon consent is retained until consent is withdrawn, whereupon it is deleted.
Upon the expiry of the applicable retention period the information is deleted and is not transferred to archival storage.
13. Security measures
The Website is served exclusively over an encrypted transport connection. Passwords are stored as one-way cryptographic hashes. Administrative access is restricted to such personnel as require it and is protected by a secondary credential. Payment card information is not received by the Company at any point, information not held being incapable of compromise.
The Company does not represent that any system is immune from compromise.
14. Rights of the data subject
Subject to the exceptions provided by law, the Customer is entitled:
- To obtain confirmation of whether personal information concerning it is processed, and to obtain a copy of that information.
- To obtain rectification of inaccurate information.
- To obtain erasure, save where the Company is required to retain the information by law.
- To obtain a copy in a structured, commonly used and machine-readable format, and to transmit it to another controller.
- To obtain restriction of processing pending the determination of a complaint.
- To object to processing founded upon legitimate interests.
- To withdraw a consent previously given.
15. Procedure upon a request
A request shall be addressed to support@ramkthrift.space and shall specify the right sought to be exercised.
The Company shall respond within thirty days. Where a request is of exceptional complexity the Company may extend that period, and shall notify the Customer of the extension within the original period rather than permit it to expire without communication.
No fee is payable in respect of a request. The Company may require verification of identity, and shall not transmit personal information to an address which it is unable to associate with the data subject.
The exercise of any right shall not result in any detriment to the Customer. Pricing, service levels and the continuation of the Account are unaffected.
16. Customers within the United Kingdom and the European Union
The rights set out above are conferred by law and are not concessions of the Company.
The Customer is not subject to any decision founded solely upon automated processing which produces legal effects concerning it or which similarly significantly affects it. The Company undertakes no profiling, scoring or automated decision-making of any description.
The Customer is entitled to lodge a complaint with the supervisory authority of its Member State or, in the United Kingdom, with the Information Commissioner's Office, and is not required to raise the matter with the Company beforehand. The Company nonetheless invites such communication, the greater part of matters referred to a supervisory authority being capable of resolution directly.
17. Customers resident in California
Within the twelve months preceding the date of this Notice the Company has collected the categories of personal information identified above, namely identifiers, commercial information concerning transactions, internet activity relating to the Website, and in certain cases a telephone number. Each such category was collected from the Customer directly or in consequence of the ordinary operation of the Website, and is processed for the purposes identified herein.
The Customer is entitled to request disclosure of the categories collected, the sources thereof, the purposes of collection and the categories of recipient; to request a copy; to request correction; and to request deletion. Such a request may be submitted by an authorised agent.
The Company does not sell personal information and does not share personal information for the purposes of cross-context behavioural advertising. No right to opt out of such activity arises, no such activity being undertaken.
The Company shall not discriminate against any Customer by reason of the exercise of any right conferred by applicable California law.
18. Customers resident elsewhere within the United States
A number of States confer rights substantially equivalent to those described above. Rather than determine the residence of each Customer, the Company extends the rights described in this Notice to all Customers irrespective of jurisdiction.
19. Minors
The Website is not directed to persons under the age of sixteen years, and the Company does not knowingly collect personal information relating to such persons. Where the Company is notified that it holds such information it shall delete it. Notification shall be addressed to support@ramkthrift.space.
20. Personal data breaches
Where a breach of security occurs which is likely to result in a risk to the rights and freedoms of the Customer, the Company shall notify the competent supervisory authority and, where the risk is high, the Customer, in each case without undue delay.
Such notification shall describe the nature of the breach, the categories and approximate number of persons affected, the likely consequences, the measures taken or proposed, and the steps which the Customer is advised to take.
21. Complaints
A complaint concerning the processing of personal information shall in the first instance be addressed to support@ramkthrift.space.
Recourse to the Company is not a condition precedent to any other remedy, and the Customer may at any time refer the matter to the supervisory authority of its place of residence. Nothing in this Notice derogates from any right conferred by law.
22. Amendment of this Notice
The Company may amend this Notice from time to time. The date of the most recent amendment appears at the head of this page.
Where an amendment is material, the Company shall notify affected Customers by electronic mail rather than rely upon their re-reading of this page.
If anything on this page is unclear, write to support@ramkthrift.space and ask. A term you did not understand is one we would rather explain than argue about later.
